Greyfundr's Terms of Service

1.1. Purpose of the Terms: Welcome to Greyfundr! These Terms of Service ("Terms"), which we may update from time to time, apply to the Greyfundr platform, including our website at www.greyfundr.com, mobile applications, and any new features we might add (collectively, the "Platform"). These Terms help define our relationship with you as you use the Platform. "Greyfundr," "we," "us," "our," and similar terms refer to the entity you are contracting with.

Our platform ensures your transactions are safe, streamlined, and easy to manage, empowering you to take control of your fundraising journey with confidence and convenience.

1.2. Acceptance of Terms: By accessing or using the Platform, you agree to be bound by these Terms. This includes creating an account, starting a fundraiser, donating, or otherwise interacting with the Platform. If you do not agree, do not use the Platform. Depending on your location, you may be contracting with different Greyfundr entities.

Key terms used in these Terms include:

• Account: A unique account created by a user to access and utilize Greyfundr's services, including personal information, credentials, and activity logs. This does not include Supporter Accounts on NPO Websites powered by Greyfundr Pro.
• Affiliate: Any entity that directly or indirectly controls, is controlled by, or is under common control with Greyfundr, including subsidiaries, parent companies, and related entities.
• Beneficiary: The individual, group, or entity for whose benefit a fundraiser is conducted and who is the intended recipient of the funds raised.
• Donor: A user who contributes funds to a fundraiser.
• Fundraiser: A campaign created on the Platform to raise funds for a specific purpose.
• Organizer: The user who creates and manages a fundraiser.
• Service Fee: A fee of 5% deducted from the total amount raised in a fundraiser, used for operational expenses such as analyzing payment data and metrics. This fee is deducted upon payout to the organizer or beneficiary.
• Payout Fee: A fee of 0.25% deducted for transferring funds from Greyfundr to the organizer or beneficiary, covering transfer charges and expenses. This fee is deducted upon transfer.

To use the Platform, you must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. You agree to provide accurate information when registering an account and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials.

Organizers may create fundraisers for lawful purposes. Donors contribute voluntarily, and all donations are final unless otherwise specified. Greyfundr does not guarantee the success of any fundraiser or the use of funds by the beneficiary.

As described in the Definitions section, we charge a Service Fee and Payout Fee. Additional fees may apply for certain services. Fees are non-refundable.

Payments are processed through third-party providers. Payouts to organizers or beneficiaries occur after fees are deducted. We are not responsible for delays caused by banks or payment processors.

You may not use the Platform for illegal activities, fraud, harassment, or to violate these Terms. Fundraisers must comply with applicable laws.

You retain ownership of content you post, but grant Greyfundr a license to use it. You agree not to post harmful, offensive, or infringing content.

The Platform and its content are owned by Greyfundr. You may not copy or use them without permission.

We may terminate or suspend your account for violations of these Terms. You may also terminate your account at any time.

The Platform is provided "as is." We do not warrant its uninterrupted or error-free operation. Use at your own risk.

To the fullest extent permitted by law, Greyfundr's liability is limited to the amount of fees paid by you in the past 12 months.

You agree to indemnify Greyfundr against claims arising from your use of the Platform or violations of these Terms.

These Terms are governed by the laws and Constitution of Nigeria

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
